- You read the will. The flags are mechanical. Execution is separate: California Probate Code § 6110 requires a writing, the testator's signature (or a permitted substitute), and, unless § 6110(c)(2) is proved, two witnesses present at the same time. Capacity is § 6100.5. You do not treat a clean consistency pass as a valid will.
