List intestate family members and leave every share blank
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- The rule is state law, and the lawyer must confirm which state's law governs. For example, Florida Statutes s 732.102 and s 732.103 set a spouse's share and the order of other heirs. From the family tree the lawyer has settled, list each person described as a spouse, descendant, or parent, and leave every share blank. Do not decide who is a spouse or a descendant.
- What the lawyer must review
- The rule is state law, and the lawyer must confirm which state's law governs. For example, Florida Statutes s 732.102 gives the surviving spouse the entire intestate estate if there is no surviving descendant of the decedent. The spouse also takes the entire estate if every surviving descendant of the decedent is also a descendant of the spouse and the spouse has no other descendant. The spouse takes one-half if a surviving descendant of the decedent is not a descendant of the spouse, and one-half if every surviving descendant of the decedent is also a descendant of the spouse but the spouse has a descendant who is not a descendant of the decedent. Section 732.103 sends the rest, or the whole estate if there is no surviving spouse, first to the decedent's descendants, then to the parents, then to siblings and their descendants, and then through the further kindred order in that section. The tool copies those alternatives and leaves the share blank. It does not decide status and it does not calculate. Another state's intestate shares were not opened.
