Screen a workplace complaint against the conduct the opened whistleblower statutes describe
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Read the complaint. Say whether it describes conduct the employee reasonably believes violates 18 U.S.C. 1341, 1343, 1344, or 1348, an SEC rule or regulation, or a federal law relating to fraud against shareholders, and whether it describes a possible federal securities-law violation reported or to be reported to the Commission. If it describes neither, say so. Do not decide that the complaint is protected.
- What the lawyer must review
- Those belief categories are the ones in 18 U.S.C. 1514A(a). The SEC program page describes information about possible federal securities laws violations. The protections page says retaliation protection under Section 21F follows a report to the Commission in writing. The opened pages do not contain a personal work-related grievance exclusion. The lawyer decides whether the complaint is inside either statute.
