- What the lawyer must review
- Section 2302(b)(8) prohibits taking, failing to take, or threatening a personnel action because of a disclosure the employee or applicant reasonably believes evidences a violation of law, rule, or regulation, or gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety, subject to the limits each subparagraph states. Subparagraph (A) applies when the disclosure is not specifically prohibited by law and the information is not specifically required by Executive order to be kept secret in the interest of national defense or the conduct of foreign affairs. The informing provision requires employees to be told the means of a lawful disclosure of classified information to the Special Counsel, the Inspector General, Congress on the conditions that sentence states, or a designated employee. Section 1514A does not supply those recipients. No Office of Special Counsel procedure page was opened.
