Keep two remedies in separate columns. For 18 U.S.C. 1514A, list make-whole relief, reinstatement with the same seniority, back pay with interest, and special damages including litigation costs, expert witness fees, and reasonable attorney fees, and the complaint path to the Secretary of Labor. For the SEC protections page, list a private action after a written report to the Commission, and the remedies that page states. Do not add the two remedies together.
What the lawyer must review
Section 1514A(b) allows a complaint to the Secretary of Labor, and a de novo district-court action if the Secretary has not issued a final decision within 180 days of filing and the delay is not due to the claimant's bad faith. An action under that paragraph is commenced not later than 180 days after the violation or after the employee became aware of it. The SEC protections page says employers may not retaliate against an employee who reported to the Commission, and that the rules require the report to be in writing before the retaliation to qualify under Section 21F. The page says the private action may seek double back pay with interest, reinstatement, reasonable attorneys' fees, and reimbursement for certain costs. It says the time limit is in Section 922 of Dodd-Frank and it does not print a number of days. A later answer on the same page also names litigation costs and expert witness fees. The lawyer picks the statute.
