- List whether the file describes a person bringing a civil action for that person and for the United States, in the name of the Government, and the seal facts in 31 U.S.C. 3730: filed in camera, under seal for at least 60 days, not served on the defendant until the court orders, and the Government's 60 days to intervene after it receives the complaint and the material evidence. Note any public disclosure and whether the person meets the original-source text printed in the section. On a separate line, note that an SEC award is the program on the SEC page. Do not state a relator's share. Do not state a contract-value threshold.
- What the lawyer must review
- 31 U.S.C. 3730(b) is the qui tam path. The complaint is served on the Government under the rule the section prints, Rule 4(d)(4); the code note says that citation probably should be Rule 4(i). The Government may seek extensions of the seal for good cause, in camera. The defendant need not respond until 20 days after the complaint is unsealed and served under Rule 4. The public-disclosure bar applies unless the Attorney General brings the action or the person is an original source. The current original-source text is an individual who either, before a public disclosure under subsection (e)(4)(a), voluntarily disclosed to the Government the information on which the allegations or transactions are based, or has knowledge that is independent of and materially adds to the publicly disclosed allegations or transactions and voluntarily provided the information to the Government before filing. The section prints the second limb as "(2) who has"; the code note says that is probably "or (ii) has". The SEC page is a different statute: an award of 10 percent to 30 percent of money collected in an action in which over $1 million in sanctions is ordered. The opened pages state no Commonwealth contract limit and no relator percentage.
