From the dates the lawyer marks, list each act, its date, and whether the lawyer has marked it as related to the others. Do not pick the date that starts time and do not write an explanation for a late application.
What the lawyer must review
  • Decide which acts are related and which date starts time
  • Do not treat an act left out of the application as payable.
  • Use the applicant's age, not the primary victim's, for a secondary or related victim.
  • Use a firm-controlled tool for health records. ASCR r 9, APP 11 and the Privacy Act 1988 (Cth) apply.

The work product

Forum. Victorian Financial Assistance Scheme time limits

Produce. A list of acts and dates, with the period the lawyer selects.

Have ready. Dates the lawyer marks as related; The applicant's date of birth; Guidelines 3 and 3.1.

Example of the limit. Illustrative example: Three acts are marked as related. The last is six years ago. The lawyer has marked it as family violence, and the applicant was an adult at the time of that act. The list shows the 10-year period running from that last date. It does not drop the earlier acts.

Stop and hand it back when

  • The lawyer has not marked which acts are related.
  • The applicant's age at the application is unknown.

Checklist

  1. Guideline 3 says that if there is more than one related act, time runs from the last related act, and an act left out cannot be paid. It does not matter that the act was before the scheme started.
  2. Age is taken at the time of the violent act. An adult then has 10 years for a sexual offence or family violence, and 3 years otherwise.
  3. A person who was a child at the time of the violent act has no time limit for child abuse or family violence, and otherwise must apply before turning 21.
  4. For a secondary or related victim, age is the applicant's age at the time of the violent act, not the primary victim's age. A related victim whose loved one died in family violence has 10 years as an adult, and no time limit as a child.

A late-application explanation is a different task. This row only sets the period.

Medical reports used to date the acts stay in a firm-controlled tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable under the Privacy Act 1988 (Cth).
