- What the lawyer must review

- Check that a significant adverse effect is shown and that the victim is a primary victim
- Check the single-offence and multiple-offence caps against the current instrument

The work product
Forum. Victorian Financial Assistance Scheme, special financial assistance
Produce. A comparison table of report extracts against the descriptors the lawyer supplies.
Have ready. Medical, dental or counselling reports; Category descriptors taken by the lawyer from the 2024 regulations; Lawyer's note on whether there was one offence or more.
Example of the limit. Illustrative example: A report describes a fracture and ongoing distress after one assault. The table quotes that passage and leaves the category blank. The lawyer checks the regulations before any amount is written.
Stop and hand it back when
- The regulations have not been opened for the category.
- The applicant is not a primary victim.

Checklist
- Confirm the applicant is a primary victim. The guidelines say secondary and related victims are not eligible for special financial assistance.
- Record whether the violent act was committed against the victim, or the victim was a child injured by exposure to it, and whether a significant adverse effect is described. Significant adverse effect includes grief, distress, trauma or injury.
- Do not assign a dollar figure from a report. The primary victims page states up to $20,000 for a single offence and $25,000 for multiple offences, and says the amount depends on the type of crime and the circumstances.
- Take the categories and the minimum and maximum amounts from the Victims of Crime (Financial Assistance Scheme) Regulations 2024. The guidelines say they do not override the regulations.

A person injured while trying to arrest, prevent a violent act, or rescue someone is not the starting point for special financial assistance, because the act was not committed against them. The lawyer decides whether the facts differ.
Special financial assistance is not paid as interim assistance.
