- Record the date the opt-out arrived, the address it names, and whether the mechanism asks for a fee, extra personal information, or more than a reply email or a single web page. List any later commercial email to that address.
- What the lawyer must review
- 15 U.S.C. § 7704 makes it unlawful for the sender to initiate a commercial email that falls within an opt-out request more than 10 business days after receipt of the request, and the same timing applies to a person acting on behalf of the sender who has the knowledge the statute describes. The FTC guide says the mechanism must be able to process opt-out requests for at least 30 days after the message, the sender must honour the request within 10 business days, and the sender cannot charge a fee, require information beyond an email address, or require any step other than a reply email or a single web page. After the opt-out, the address cannot be sold or transferred except to a company hired to help comply with the Act.
