Check a calling list against the National Do Not Call Registry and the consent rules before the calls
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Separate the list into numbers the seller must scrub against the National Do Not Call Registry, numbers on that seller's own do-not-call list, and calls or texts that need prior consent because they are autodialed or prerecorded. Note the date the Registry file was last downloaded.
- What the lawyer must review
- The Telemarketing Sales Rule makes it a violation to make covered calls without having accessed the National Do Not Call Registry, and sellers and telemarketers must delete Registry numbers from their lists at least every 31 days. It is also a violation to call a consumer who has asked not to be called by or for that seller. The FTC guide states a civil penalty of up to $53,088 for each violation of that entity-specific rule, and it treats calling before 8 a.m. or after 9 p.m. as an abusive practice. The FCC guide requires prior written consent for a prerecorded telemarketing call to a home or wireless number, and oral or written consent before an autodialed or prerecorded call or text to a wireless number. Those FCC rules apply even if the number is not on the Registry.
