- You decide the location and the duty. Under California Civil Code § 4775, unless the declaration provides otherwise, the association maintains the common area and the owner maintains the separate interest, and exclusive-use common area is maintained by the owner and repaired and replaced by the association. You read the declaration before you use that allocation. The table copies the papers. It does not apply the section. This is California. Other states use their own statutes. Model Rule 1.6 applies to the file.
