- How AI is used
- Draft the amendment so that it follows the motion the members approved, and list the approval, certification and recording steps the governing documents require.
- What the lawyer must review
- In California, Civil Code § 4270 says a declaration may be amended pursuant to the declaration or the Davis-Stirling Act. Unless a listed alternative process applies, the amendment is effective only after it is approved by the percentage of members the declaration requires (or, if the declaration is silent, by a majority of all members under the section), certified in an acknowledged writing by the designated officer or the president, and recorded in each county where part of the development lies. You check the recorded declaration's own amendment clause and the vote before anything is signed or recorded. Other states do not use § 4270.
