Key facts

- RedLawyer-led
- How AI is used
- From the sheet the lawyer supplies, list the event, the player, the term, any grant of a game, broadcast or recording, and any use of a name or likeness, in the sheet's words. Write no sentence of the participation agreement. Add no rule that is not printed on the sheet.
- What the lawyer must review
- You write the agreement. If a clause is a transfer of copyright ownership, § 204(a) requires a signed writing, and § 106, subject to §§ 107 through 122, is the list of exclusive rights. Open § 102 before you treat a game or a broadcast as a work of authorship. Civil Code § 3344(a)(1) is the California liability rule for a knowing use of a name, voice, signature, photograph or likeness without the prior consent that section requires, including a parent or guardian's consent when the person is a minor. If the player is an unemancipated minor, § 6750(a)(3) includes a contract entered on or after 1 January 2000 under which the minor is employed or agrees to render services as a participant or player in a sport, and § 6750(a)(1) includes artistic or creative services, which the section's list includes a content creator. Section 6750(c)(1) defines a content creator to include streamers. You decide whether this agreement is a contract of a type § 6750 describes. If it is, § 6752 states a set-aside of 15 percent of gross earnings pursuant to the contract, with the exceptions in that section. The opened text of § 6750 does not use the word esports.
