California Civil Code § 3344 imposes liability for knowing commercial use of a name, voice, signature, photograph or likeness without prior consent, and a minor's consent is the parent or guardian's. Section 3344(d) and (e) carve out news and some sponsored uses. A false suggestion of sponsorship can also be a 15 U.S.C. § 1125(a) problem. The Copyright Office's Part 1 report (31 July 2024) is the federal discussion of digital replicas. It is not itself a cause of action.
