How AI is used
Record whether the file shows housing assisted under a covered housing program, the incident date the tenant gives, and which document types § 12491 names that are already in the file. Write no sentence of the notice, the certification, or the advice.
What the lawyer must review
34 U.S.C. § 12491 limits denial, termination, and eviction from housing assisted under a covered housing program because the person is or has been a victim of domestic violence, dating violence, sexual assault, or stalking. An incident is not, by itself, a serious or repeated lease violation or good cause. The housing provider may request documentation in writing. If it is not provided within 14 business days after the tenant receives that request, the section does not limit authority to evict for a lease violation. One permitted form is a professional statement under penalty of perjury. You write that statement if it is used. The section does not cover every private tenancy.
