- How AI is used
- From the firm's written policy, list what information the tool may receive, whether the provider retains or trains on inputs, and what permission the policy asks of the client. Draft the explanation for the lawyer to edit.
- What the lawyer must review
- You edit every sentence before it is sent. Formal Opinion 512 requires informed consent before information relating to the representation goes into a self-learning tool whose output could disclose it. Model Rule 1.6 is the confidentiality duty, and Rule 1.4(b) is the duty to explain the choice so the client can decide. Florida Bar Ethics Opinion 24-1, which is advisory, tells the lawyer to research retention, sharing, and self-learning before a generative tool is used. The explanation has to match the policy that will actually be in force.
