Find gaps in a residential seller-disclosure pack
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List the disclosure documents in the file against the categories the lawyer has taken from the state statute. For a California single-family transfer, mark whether a disclosure pack is present. Do not waive anything and do not write the disclosure.
- What the lawyer must review
- California Civil Code § 1102(a) applies the disclosure article, except as § 1102.2 provides, to a transfer by sale, exchange, real-property sales contract, lease with an option to purchase, other option to purchase, or ground lease coupled with improvements, of single-family residential property. Section 1102(c) says any waiver of the article is void as against public policy. You open § 1102.2 before treating a transfer as exempt, and you open the current form. Other states have their own disclosure statutes or none. Do not use an Australian vendor-disclosure statement.
