List mortgages and caveats named before any deposit is released
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- List each mortgage and each caveat the file names, and who the contract says holds the deposit. Do not authorize a release and do not say a caveat blocks it.
- What the lawyer must review
- You decide whether the deposit can be released early. No priority or caveat statute was opened, so a listed dealing is not ranked. The holder is the person the contract names. Model Rule 1.4(b) requires an explanation before the client agrees to a release. Rule 11(b)(3) applies if you later allege that the land is clear. Formal Opinion 512 requires you to verify the list against the searches in the file. A dealing that is not in those searches is not added.
