Prepare the application for court review of a lawyer-discipline sanction
Key facts

- RedLawyer-led
- How AI is used
- List the sanction in the report, the date of service if the file shows it, and whether the sanction is suspension or disbarment. Write no objection, brief or petition.
- What the lawyer must review
- You write every sentence that is filed. Model Rule 11 on review by the court says the court may, in its discretion, review a matter if the respondent or disciplinary counsel files objections to the report of the board, or if a majority of the court, within the time for filing objections, votes to review. If the court does not review and the sanction decided by the board, or by the hearing committee where the board declined review, is suspension or disbarment, the court shall impose the sanction. The model says objections may be filed within a bracketed period of twenty days from service of the board report, and that within a bracketed period of sixty days after the court grants review the parties may file briefs and present oral argument pursuant to the rules governing civil appeals. The court enters a written order stating the reasons. Those day counts are in brackets. They are not the rule of any state. The adopting court's appellate rules control the form of the application. Model Rule 3.3 on candour to the tribunal applies to what you file. Federal Rule of Civil Procedure 11 does not apply unless the proceeding is in a court that uses that rule.
