Index the disciplinary file and the practitioner's records
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Index each document by date, author and what it is: complaint, notice, formal charges, answer, hearing report, or the practitioner's own record. Quote nothing into a filing.
- What the lawyer must review
- You decide what the index is used for. ABA Model Rules for Lawyer Disciplinary Enforcement, Rule 11, as a model, provides for evaluation and investigation, written notice of the substance of the matter and an opportunity to be heard before a recommendation other than dismissal or stay, formal charges with fair and adequate notice, a written answer, a hearing, and review. The model places several time periods in brackets. Those brackets are not the rule of any state. Model Rule 1.6 prohibits revealing information relating to the representation unless the client gives informed consent, the disclosure is impliedly authorised, or paragraph (b) permits it, and requires reasonable efforts against unauthorised disclosure. The index stays inside the matter. ABA Formal Opinion 512 requires independent verification of a generated index before you rely on it.
