Respond to a Clean Water Act compliance order

- How AI is used
- Extract from the order the violation as the order describes it, the recipient, the compliance time, and every fact the client disputes. Draft no response.
- What the lawyer must review
- 33 USC section 1319 authorises the Administrator to issue a compliance order for violations of the listed sections or of a permit condition implementing them. An order under that subsection must be served personally, must state with reasonable specificity the nature of the violation, and must specify a time for compliance, not exceeding 30 days for an interim schedule or operation-and-maintenance violation, and a time the Administrator finds reasonable for a final deadline. A copy goes to the state and, for a corporation, to appropriate officers. The Administrator may also sue in the district court for an injunction. If you file a paper in that court, Rule 11 is your certification after a reasonable inquiry. You write the response. Opinion 512: do not file a generated citation.
