- How AI is used
- Set out section 66001(a) and (b) as a menu and leave every line blank unless the lawyer has marked it: the purpose of the fee; the use of the fee, and the facilities if the use is financing public facilities; the reasonable relationship between the use of the fee and the type of development; the reasonable relationship between the need for the facility and the type of development; and the reasonable relationship between the amount of the fee and the cost attributable to the development. Do not draft the condition.
- What the lawyer must review
- The lawyer decides whether a fee condition may be imposed and what it says. California Government Code section 66001(a) and (b) are the determinations. Paragraph (a)(2) says that if the use is financing public facilities, the facilities shall be identified, and that the identification may be by a capital improvement plan, a general or specific plan, or another public document. No other condition power was opened. A condition that is not a fee is outside this menu. The department page is the same rule in the department words. This is California. Other states differ.
