Take only the approvals the lawyer has listed. Mark each one as an NPDES permit, a permit for dredged or fill material, a NEPA environmental document, or none of those. Do not add an approval the lawyer has not listed. Do not say the list is complete.
What the lawyer must review
The lawyer decides which approvals this proposal needs. Section 1311(a) of title 33 makes the discharge of any pollutant unlawful except as in compliance with listed sections, including sections 1342 and 1344. Section 1342 is the NPDES permit. Section 1344 is the permit for dredged or fill material. The EPA NPDES page says a point-source discharge of pollutants into a water of the United States needs an NPDES permit. The EPA section 404 page says a permit is required before dredged or fill material is discharged into waters of the United States, unless the activity is exempt. Those exemptions were not opened. Section 4332(2)(C) says that, before making the detailed statement, the head of the lead agency shall consult with and obtain the comments of any Federal agency which has jurisdiction by law or special expertise with respect to any environmental impact involved. A local zoning approval is not one of these three federal approvals.
