List the matters in an environmental impact statement
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Set out the five matters in section 4332(2)(C) and leave blank whether each is addressed in the draft: the reasonably foreseeable environmental effects of the proposed agency action; any reasonably foreseeable adverse environmental effects which cannot be avoided if the proposal is implemented; a reasonable range of alternatives that are technically and economically feasible and meet the purpose and need, including the no-action alternative; the relationship between local short-term uses of the environment and the maintenance and enhancement of long-term productivity; and any irreversible and irretrievable commitments of Federal resources. Do not decide that an effect is significant. Do not write the statement.
- What the lawyer must review
- The lawyer decides whether a statement is required and whether the draft covers each matter. Section 4332(2)(C) requires the detailed statement for proposals for legislation and other major Federal actions significantly affecting the quality of the human environment, except where compliance would be inconsistent with other statutory requirements. Section 4336e defines a major Federal action as an action that the agency carrying it out determines is subject to substantial Federal control and responsibility, and defines an environmental impact statement as the detailed written statement required by section 4332(2)(C). Section 4336(b) says the agency shall issue an environmental impact statement for a proposed action requiring an environmental document that has a reasonably foreseeable significant effect on the quality of the human environment. This list is not a local zoning findings list.
