- California Government Code section 65850 lets a city or county regulate by ordinance the use of buildings, structures and land. The zoning answer is in that local ordinance, not in a national code. Separately, 42 USC section 4332(C) requires a detailed statement for major federal actions significantly affecting the quality of the human environment, and 33 USC section 1344 authorises the Secretary of the Army, through the Chief of Engineers, to issue permits for discharge of dredged or fill material into navigable waters after notice and an opportunity for a public hearing. CEQ's own NEPA regulations were removed from the Code of Federal Regulations by a final rule effective 8 January 2026, so do not treat 40 CFR parts 1500 to 1508 as current CEQ rules.
