Check whether a discharge can proceed under a general permit
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the activity description and the general permit the lawyer identifies, list the conditions the papers say apply and whether the file records that those conditions are met. Leave blank whether the activity may proceed under that general permit. Do not say an individual permit is unnecessary.
- What the lawyer must review
- The lawyer decides whether the activity qualifies. The EPA section 404 page says a general permit may suit most discharges that will have only minimal adverse effects. A general permit is issued on a nationwide, regional, or state basis for a category of activities. The page says the general permit process eliminates individual review and allows certain activities to proceed with little or no delay, provided the general or specific conditions are met. It gives minor road activities, utility line backfill, and bedding as examples that can be considered. An individual permit is required for potentially significant impacts. Section 1344 of title 33 authorises the Secretary to issue a permit for the discharge of dredged or fill material. The exemptions the page mentions for certain farming and forestry activities were not opened.
