How AI is used
From the permits, plans, and other documents the lawyer selects, list the use, the date it is said to have been lawfully begun or in existence, and the zoning change said to make it nonconforming. Do not say that the use is protected.
What the lawyer must review
The lawyer decides whether Massachusetts General Laws chapter 40A, section 6, protects the use. The section says a zoning ordinance or by-law shall not apply to structures or uses lawfully in existence or lawfully begun, or to a building or special permit issued, before the first publication of notice of the public hearing on that ordinance or by-law. It shall apply to any change or substantial extension of the use, and to reconstruction, extension, or structural change, except where an alteration, reconstruction, extension, or structural change to a single-family or two-family residential structure does not increase the nonconforming nature of the structure. An extension or alteration of a pre-existing nonconforming structure or use needs a finding by the permit granting authority, or the special permit granting authority, that the change, extension, or alteration shall not be substantially more detrimental than the existing nonconforming use to the neighbourhood. The lawyer writes the advice. The City of Atlanta page describes a nonconforming use as a land use that does not comply with the current zoning. Its ordinance chapter was not opened, and it is not the rule applied here.
