Assemble a Victorian proclaimed-disease compensation application
MaintainedLast reviewed
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Assemble the diagnosis, the process and the employment fields the WorkSafe page uses for a proclaimed disease, each with a source. Do not complete any declaration.
- What the lawyer must review
- Check every field against the record before anything is sent.
- The proclamation and the form were not opened. The lawyer confirms both.
- The person who submits completes any declaration. The tool writes nothing there.
- Keep the reports in the firm tool under ASCR r 9, APP 11 and the Privacy Act 1988 (Cth).

The work product
Forum. WorkSafe Victoria proclaimed diseases
Produce. A field set for a proclaimed-disease claim, with the form and the proclamation left for the lawyer to confirm.
Have ready. Diagnosis; Process and dust; Employment records; Whether the applicant is the worker or a dependant.
Example of the limit. Illustrative example: The diagnosis is lung cancer with silicosis after silica-dust work. The tool assembles the diagnosis and the process from the records and marks the proclamation as not opened. The lawyer checks the instrument and the form before anything is sent.
Stop and hand it back when
- The output says the disease is proclaimed without the instrument.
- A declaration is filled by the tool.

Who does what
| Role | What they do |

| Lawyer | Set the scope, supervise the work closely, verify every part relied on, resolve omissions and exceptions, and approve the exact output. |
Checklist
- The page says a worker or dependant with a proclaimed disease is entitled to compensation irrespective of whether work is proved to have contributed, unless WorkSafe or a self-insurer proves the disease was not due to employment.
- Silicosis with or without pulmonary tuberculosis was already listed for processes involving inhalation of silica dust. Lung cancer with silicosis and scleroderma with silicosis are added on that page.
- The 2022 amendments page names s 51A for eligible progressive diseases, a deemed minimum 30 per cent impairment after a lung transplant, and extended family counselling. Those are separate from the proclamation.
- No form number was opened. Do not invent one.
