Section 328(4) requires the application to be in the approved form, with a signed medical authority, copies of all medical reports, and affidavits attesting to other material existing when the application is made of which the worker or the legal representative is aware and on which the worker intends to rely. WorkSafe says Form A includes an affidavit describing how the injury happened and its effect, the medical reports, tax returns or proof of earnings for the 3 years before the injury to the date of the application, Form D, and a statement of claim. The affidavit is not generated. Practice Note SC GEN 25, issued and commencing on 14 May 2026, treats an affidavit as a court document. The County Court has issued its own practice note for court users. The news page does not state that note's number.
