From the place of the accident, the registration, the injured person's residence and role, and any other scheme, draft a note naming the Transport Accident Commission where the eligibility policy covers the accident. List the facts still missing. Do not decide entitlement.
What the lawyer must review
  • Decide whether the Commission is the recipient
  • Check the police report, apart from the stated pedal-cycle window
  • Check whether another statutory scheme already covers the injury
  • Health records stay in the firm tool. ASCR r 9 and APP 11 apply, and a breach may be notifiable.

Checklist

  1. An accident in Victoria is covered regardless of where the vehicle is registered. An accident outside Victoria is covered only if it involves a Victorian-registered vehicle and the injured person is a Victorian resident or an occupant of that vehicle.
  2. The Commission accepts a claim only after proof that the accident was reported to the police, and where relevant to the train or tram operator, except a pedal-cycle collision with a stationary or parked motor vehicle between 9 July 2014 and 26 September 2018.
  3. There is no entitlement where the person is entitled to compensation through another statutory scheme. The policy's list includes the Workplace Injury Rehabilitation and Compensation Act 2013.
  4. If the person can claim in another place, the Commission must deny or stop benefits once a claim is accepted, compensation or damages are paid, an award is entered, the claim is settled, a payment into court is accepted, or an action for damages is commenced.

Sources

The common-law policy, not the eligibility page, deals with naming the Commission as defendant where the vehicle cannot be identified. That page sets no number of days.

The eligibility page also restricts some private-land, sports and offence cases. The lawyer reads that page before treating those accidents as covered.
