Key facts
- Human involvement
- RedLawyer-led
- How AI is used
- In a firm-controlled tool, list open questions on liability, scheme, injury, time and missing evidence, and tie each question to a document or note already in the file. The tool writes none of the advice, and none of any letter the client receives.
- What the lawyer must review
- Write the prospects advice yourself. The tool writes none of it.
- Decide which questions are real, and which file source they rest on.
- Do not let the list answer section 28C, the scheme, or the limitation period.

The work product
Forum. Victoria: open questions for an early plaintiff prospects advice
Produce. An internal list of open questions. The lawyer writes the advice.
Have ready. Documents and notes already in the file; Questions the lawyer marks as open.
Example of the limit. Illustrative example: The file has a shop fall and no medical report. The list asks what the mechanism was, and whether Part VB applies, and ties each question to the intake note. It does not answer them. The lawyer writes the advice.
Stop and hand it back when
- The tool would write the prospects advice or a letter the client receives.
- The list would state a limitation date.

Checklist
- Each question is tied to a document or note already in the file. A question with no source is marked as missing.

- Rule 7.1 is the lawyer's duty to give clear and timely advice. The tool writes none of that advice.
- The list is not evidence, is not filed, and is not sent to the client.

Rule 7.1, in the New South Wales consolidation of the Uniform rules, requires a solicitor to provide clear and timely advice to assist a client to understand the relevant legal issues and to make informed choices, consistent with the terms of the engagement. The lawyer writes that advice. This list does not.
The list can flag, without answering, whether section 28C takes a damages award outside Part VB, whether a transport accident was a journey or during the course of work on the TAC policy, and whether a disability at the date of the act or omission means section 27D does not apply and section 27E does, and only where section 27B leaves the claim inside that Part.
