Checklist
- The bench book states the test for approval as whether the court is satisfied the compromise is in the best interests of the plaintiff. The list does not apply that test and does not say what the court should do.
- The bench book says the cost of management is often recoverable as damages and is a factor in the adequacy of the settlement, including supervision by the NSW Trustee where the manager is someone else. The list records a fee estimate only where the lawyer has accepted one. It does not say the fee will be recovered.
- Each repayment is tied to section 151A or section 3.40, and the holding of the balance is noted as section 77(2) where that section applies. The list does not calculate costs.
- Practice note SC Gen 23, paragraph 10, says generative artificial intelligence must not generate the content of an affidavit or other evidence. The lawyer writes the advice and any evidence. This list is neither.

Health and wage records stay in a firm-controlled tool. The lawyer applies ASCR r 9 and APP 11, and decides whether any breach is notifiable under the Privacy Act 1988 (Cth).
The bench book says that, in general, the compromise should not be on an inclusive-of-costs basis. If the lawyer has marked it that way, the list records the mark and does not resolve it.
