Key facts

- How AI is used
- Table the states where the service would be offered and the federal provisions the lawyer has named. State no conclusion on whether the service is lawful.
- What the lawyer must review
- The Wire Act, 18 U.S.C. § 1084, prohibits a person in the business of betting from knowingly using a wire communication facility to transmit bets or wagers on a sporting event in interstate or foreign commerce, with a stated exception for information sent between places where that betting is legal. The Unlawful Internet Gambling Enforcement Act, 31 U.S.C. § 5363, prohibits a person in that business from knowingly accepting a financial instrument in connection with unlawful internet gambling. Murphy v. NCAA held that PASPA's ban on state authorization and licensing of sports-gambling schemes violates the anticommandeering doctrine and that the rest of PASPA could not be severed. It does not issue a federal license. The state where the bet is offered decides whether to license sports betting. The lawyer gives the advice.
