Run the conflict check at legal-aid intake and record the result
Key facts

- YellowClose supervision
- How AI is used
- Compare the names on the intake sheet with the names the conflict system returns, and list each hit with the matter number. Do not clear the conflict.
- What the lawyer must review
- Model Rule 1.7 prohibits representation if it involves a concurrent conflict, unless the lawyer reasonably believes the representation will be competent and diligent, the representation is not prohibited by law, it does not involve asserting a claim by one client against another client represented by the lawyer in the same litigation or other proceeding before a tribunal, and each affected client gives informed consent, confirmed in writing. Model Rule 1.10(a) imputes a Rule 1.7 or 1.9 prohibition to lawyers associated in a firm, unless the personal-interest exception or the former-client screening conditions are met. Screening under Rule 1.10(a)(2) requires timely screening, no part of the fee to the disqualified lawyer, prompt written notice to the former client describing the screen, and certifications. You decide whether there is a conflict and whether consent or a screen is available. A legal-aid program is a firm for imputation if the state's rule treats it as one. Record the result in the file. Do not put the other client's confidential information into the new client's record.
