- What the lawyer must review
- 45 C.F.R. § 1611.8 says that if, after accepting a client, the recipient becomes aware that the client is financially ineligible because of a change in circumstances, it shall discontinue representation supported with LSC funds if the change is sufficient, and is likely to continue, to enable the client to afford private legal assistance, and discontinuation is not inconsistent with the rules of professional responsibility. The same duty applies if later-discovered information shows the client was ineligible, again unless discontinuation would be inconsistent with those rules. 42 U.S.C. § 2996f(a)(2) is the statute that requires maximum income levels and eligibility guidelines.
