- YellowClose supervision
- How AI is used
- List whether the matter is a criminal charge, whether it is in a tribal court, and whether the client is already being represented by the program in a related matter.
- What the lawyer must review
- 42 U.S.C. § 2996f(b)(2) says Corporation funds may not be used to provide legal assistance in a criminal proceeding, except assistance to a person charged with an offense in an Indian tribal court. 45 C.F.R. § 1613.3 repeats that bar unless the part authorizes the work. Section 1613.4 allows representation when professional responsibility requires it in a criminal proceeding arising out of a transaction in which the recipient is or was representing the client, and § 1613.5 addresses a charge in an Indian tribal court. Separate representation of criminal co-defendants is not a rule on these pages. It is a public-defender question under state law.
