- How AI is used
- From the proposal and the facts learned later, list each fact said to have been concealed, whether the file says it was material, and whether the other party had the means of ascertaining it. Do not decide that the insurer may rescind.
- What the lawyer must review
- California Insurance Code § 331 says concealment, whether intentional or unintentional, entitles the injured party to rescind insurance. Section 332 says each party shall communicate to the other, in good faith, all facts within his knowledge which are or which he believes to be material to the contract and as to which he makes no warranty, and which the other has not the means of ascertaining. You decide whether the fact was material and whether rescission is open, and you write the advice. Do not import the remedy menu in the Insurance Contracts Act 1984 (Cth) for a relevant failure.
