Review the policy wording and build a coverage table
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Extract insuring clause, exclusions, conditions, limits, deductible, and the claims-made or occurrence label into a table, each with the page. Do not state whether a loss is covered.
- What the lawyer must review
- 15 U.S.C. § 1012(a) leaves the business of insurance to state law, and § 1012(b) says an Act of Congress does not override a state insurance statute unless the Act specifically relates to the business of insurance. You read the policy against the state's coverage cases. California Insurance Code § 790.03 includes misrepresenting to claimants pertinent facts or policy provisions relating to coverages at issue. The NAIC model Act is not itself the state's law. Formal Opinion 512: verify every citation before the table is used.
