- Record whether the file contains the wage comparison, the working-conditions statement, the strike or lockout statement, the notice statement, and the worker count, occupation, and wage specification. Do not compute a wage. Write no application.
- What the lawyer must review
- 8 U.S.C. section 1182(n)(1) says no alien may be admitted or provided H-1B status in an occupational classification unless the employer has filed with the Secretary of Labor an application stating the following. Paragraph (A)(i) states that the employer is offering and will offer, during the authorized employment, wages at least the actual wage paid to all other individuals with similar experience and qualifications for the specific employment, or the prevailing wage for the occupational classification in the area of employment, whichever is greater, based on the best information available at filing. Paragraph (A)(ii) states that the employer will provide working conditions that will not adversely affect workers similarly employed. Paragraph (B) states that there is not a strike or lockout in the course of a labor dispute in the occupational classification at the place of employment. Paragraph (C) states that, at filing, notice was given to the bargaining representative of employees in that classification and area, or, if there is none, by physical posting in conspicuous locations or electronic notification to employees in that classification. Paragraph (D) requires the number of workers sought, the occupational classification, and the wage rate and conditions. Paragraph (E) on displacement is not applied, because the applications described in clause (ii) of that paragraph were not read. The tool does not decide whether the application complies and does not compute a wage. This is not an Australian sponsorship-obligation regime. The Cornell page is not the official edition.
