How AI is used
List each allegation in the file, when it was formed, whether the notes say it involves abuse or serious bodily injury, and whether a report is already in the file. Do not say a report was late.
What the lawyer must review
You decide whether a report is due, and only for a facility covered by 42 CFR § 483.12. A covered individual reports a reasonable suspicion of a crime to the State Agency and to one or more law enforcement entities immediately, and not later than 2 hours after forming the suspicion if the events cause serious bodily injury, otherwise not later than 24 hours. The facility reports an alleged violation involving abuse, neglect, exploitation, mistreatment, an injury of unknown source, or misappropriation on the same 2-hour or 24-hour split stated in § 483.12(c). Section 1150B of the Act was not opened. The times are the words in § 483.12. This is not a hospital sentinel-event rule. No such rule was opened. Formal Opinion 512 applies to the file.
