Build a clinical chronology and an issues table from the records
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- In date order, list the visit, the provider, and the fact the record states. In a second table, list the issue the lawyer names and the pages that relate to it. Do not diagnose and do not state a breach of duty.
- What the lawyer must review
- You decide which facts matter and whether any duty was breached. 45 CFR § 164.502 limits use and disclosure of protected health information by a covered entity or a business associate. Section 164.524 requires the covered entity to act on a request for access no later than 30 days after receipt, with one extension of no more than 30 days if it gives a written statement of the reasons and the completion date. You read the exception in § 164.524(b)(2) before relying on a different period. Formal Opinion 512 applies before the records go into a tool. The chronology is not a medical opinion.
