Log medical records against a subpoena's categories
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- For each category the subpoena commands, list the record in the file that matches it or mark the category as not in the file. Do not decide that production is permitted.
- What the lawyer must review
- Rule 45(a) requires a subpoena to state the court, the title and civil-action number, and to command the person to attend and testify, to produce designated documents, electronically stored information, or tangible things in that person's possession, custody, or control, or to permit inspection, and to set out the text of Rule 45(d) and (e). You read (d) and (e) before a command is answered. Those subsections were not the source of this log. 45 CFR § 164.502 still limits disclosure of protected health information. A match between a category and a record is not a decision that the disclosure is permitted. You make that decision. Formal Opinion 512 applies to the use of a tool on the records.
