List the event before deciding whether a report is required

- List the event in the file's words and the date the file states. Do not say a report to a data bank is required.
- What the lawyer must review
- You decide whether any report is required. The data-bank page that was requested did not load, so no reporting duty from that page is stated. 42 CFR § 483.12 sets duties for a facility that section covers, including reports of suspected crimes and of alleged abuse, neglect, exploitation, mistreatment, injuries of unknown source, and misappropriation. Those duties are not a national rule that every practitioner must report every event to a data bank. You use the section only if you confirm the setting is one it covers. Model Rule 1.6 applies to information relating to the representation while you decide. Formal Opinion 512 applies before the file goes into a tool.
