- What the lawyer must review
- California Rule of Court 5.83 requires a family centered case resolution process for dissolution, legal separation, nullity, and parentage cases. The court may add other family law case types. For cases filed on or after 1 January 2013, the court must review those cases within at least 180 days of the initial filing and at least every 180 days after that until disposition. Unless the court determines that procedural milestones are being met, the review must include a status conference or a family centered case resolution conference. Disposition means final judgment, dismissal, change of venue, or consolidation into a lead case. A status conference is a court event with the parties and attorneys to identify the status and the next steps. The percentages in subdivision (c)(5), for dissolution, legal separation, and nullity cases filed on or after 1 January 2014, are goals for how many cases the process should dispose within 6, 12, and 18 months. They are not a deadline imposed on a party. Code of Civil Procedure sections 583.210 and 583.310, mentioned if both parties have failed to participate for 18 months, were not opened. There is no compliance mention in the rule. You prepare the appearance. Opinion 512.
