List the allegations of child abuse the custody file already states, and record whether the file contains a court request that the child welfare services agency investigate. Write no notice.
What the lawyer must review
Family Code section 3027 does not require a party to file a notice. Subsection (a) provides that if allegations of child abuse, including child sexual abuse, are made during a child custody proceeding and the court has concerns about the safety of the child, the court may take any reasonable temporary steps it deems appropriate to protect the child until an investigation can be completed. It does not affect Welfare and Institutions Code sections 16504 and 16506, which were not opened. Subsection (b) provides that the court may request the local child welfare services agency to investigate under Welfare and Institutions Code section 328, which was not opened, and the agency then reports its findings to the court. You do not file a notice the section does not describe. Opinion 512 and Model Rule 1.6.
