Prepare a covered-housing transfer or lease split after domestic violence
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- From the tenancy file, record the housing program, whether the person has asked for an emergency transfer or a lease bifurcation, and which document is offered as proof. Do not decide that the housing is covered and do not send a notice.
- What the lawyer must review
- The lawyer decides whether 34 U.S.C. § 12491 applies. The protections opened here are for housing assisted under a covered housing program, not for every private tenancy. An applicant or tenant may not be denied admission, denied assistance, terminated, or evicted because the person is or has been a victim of domestic violence, dating violence, sexual assault, or stalking, if the person otherwise qualifies. A public housing agency or owner or manager may bifurcate a lease to evict or terminate assistance to an individual who engages in criminal activity directly relating to that violence against an affiliated individual, without penalising a victim who is also a tenant or lawful occupant. If the remaining person cannot establish eligibility, the provider shall give a reasonable time, as the appropriate agency determines, to find other housing or establish eligibility under another covered program. A provider may request documentation. If it is not provided within 14 business days after the tenant receives the written request, the provider's ordinary authority is no longer limited by the subpart, and the provider may extend that deadline. Acceptable documentation includes an agency certification, a statement signed by the victim and by a victim-service provider, attorney, medical professional, or mental health professional under penalty of perjury, a law-enforcement, court, or administrative record, or other evidence the provider accepts. HUD's VAWA page says a person in HUD-subsidized or assisted housing can request an emergency transfer and a lease bifurcation, and can prove status with Form HUD-5382 unless the provider has conflicting information. The statute's emergency-transfer plan allows a transfer to another available and safe dwelling unit assisted under a covered program when the tenant requests it and reasonably believes there is a threat of imminent harm from further violence if the tenant stays, or, for sexual assault, the assault occurred on the premises during the 90 days before the request.
