Check a joint custody order against the opened modification section
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- Record whether the order in the file is a joint custody order, who the file says has asked to change it, and whether the file says a parent opposes the change. Do not decide the best interest of the child, and write no proposed order.
- What the lawyer must review
- Family Code section 3087 provides that an order for joint custody may be modified or terminated on the petition of one or both parents, or on its own motion, if it is shown that the best interest of the child requires modification or termination. If either parent opposes the modification or termination, the court shall state in its decision the reasons for it. The section does not speak to an order that is not a joint custody order. No other custody-modification statute was opened. You decide best interest and you write any proposed order. Opinion 512 and Model Rule 1.6.
