List the child's habitual-residence facts, the date of the removal or retention, and any court order in the file. Write no petition and no exception argument.
What the lawyer must review
You decide whether the Convention applies and you write any petition. 22 U.S.C. § 9001 states that the Hague Convention on the Civil Aspects of International Child Abduction, done at The Hague on 25 October 1980, provides for the prompt return of children wrongfully removed or retained, and that ICARA implements the Convention in the United States. Courts decide rights under the Convention, not the merits of the underlying custody claim. State custody statutes, including California Family Code § 3020 where it applies, do not decide the return application. Opinion 512: you verify every date and authority before filing.
