Check whether a joint-custody order may be changed
Key facts
- Human involvement
- YellowClose supervision
- How AI is used
- State whether the order in the file is a joint-custody order. If it is, list later events in date order and leave a blank for whether the best interest of the child requires a change. If it is not joint custody, leave the test blank. Decide nothing.
- What the lawyer must review
- Section 3087 applies only to an order for joint custody. That order may be modified or terminated on the petition of one or both parents or on the court's own motion if it is shown that the best interest of the child requires modification or termination. If either parent opposes the modification or termination, the court shall state the reasons in its decision. The section does not state a significant-change test. It was operative on 1 January 1994. A sole-custody order is a different section, which was not opened. If the order is not joint custody, section 3087 does not apply. You read best interest with section 3011. You decide whether a change is required.
