- How AI is used
- If the file shows an Indian child as section 1903 defines that term, list each person the file names and leave a blank for whether that person is an extended family member, a parent, or an Indian custodian under the section. If the file does not show an Indian child, leave the list blank. Decide nothing.
- What the lawyer must review
- Section 1903 applies only when the child is an Indian child: an unmarried person under age eighteen who is a member of an Indian tribe, or who is eligible for membership in an Indian tribe and is the biological child of a member of an Indian tribe. An extended family member is defined by the law or custom of the Indian child's tribe or, in the absence of such law or custom, a person who has reached the age of eighteen and who is the child's grandparent, aunt or uncle, brother or sister, brother-in-law or sister-in-law, niece or nephew, first or second cousin, or stepparent. A parent means any biological parent of an Indian child or any Indian person who has lawfully adopted an Indian child, including adoptions under tribal law or custom. It does not include the unwed father where paternity has not been acknowledged or established. An Indian custodian means any Indian person who has legal custody of an Indian child under tribal law or custom or under State law, or to whom temporary physical care, custody, and control has been transferred by the parent. A child custody proceeding under the section includes foster care placement, termination of parental rights, preadoptive placement, and adoptive placement. It does not include a placement based upon an act which, if committed by an adult, would be deemed a crime, or an award, in a divorce proceeding, of custody to one of the parents. If the file does not show an Indian child, the section does not apply. It does not define family for an Aboriginal or Torres Strait Islander child. California Family Code section 3011 is a different statute. This section is not a national children's court.
